RENTAL AGREEMENT

For your protection and ours, we require that all renters sign and return the Rental Agreement, which is made between Lost Cavern LTD Owner/Agent and Renter

We are glad you are staying at our place! Please read our cabin rules and regulations to sign and return prior to your stay. Contact us at (740)819-3156 if you have any questions. When you arrive at the cabin, please inspect for any damages and call if you see any. All renters must be the minimum age of 25 years. As the responsible member of your group, Renter will be responsible for anything that occurs during the stay. Renter must be present at the time of check-in and throughout the duration of your entire stay.

PAYMENTS AND DEPOSITS

Any reservation made must be paid in full at the time of making the reservation. Rates are on a per night basis. All reservations shall include in addition to the rental amount such sales, lodging and other taxes required by law. Any charges related to excess cleaning, damage to property and/or contents and any charge associated with violating any rental agreement will be charged to Renter’s credit card on file within 30 days of departure and an itemized list of charges will be sent or detailed to the address on record.

For your convenience we accept Visa, MasterCard, Discover and American Express Credit Cards. We do not accept debit cards or personal checks. However, we will accept certified checks or money orders if paid more than thirty (30) days in advance of your scheduled arrival date. However, we will need a credit card on file as a damage deposit. Please call for arrangements.

REFUNDS/CANCELLATIONS

  • Our cancellation policy is strictly adhered to-no exceptions.

  • Cancellations more than thirty (30) days in advance of your scheduled arrival date will receive a full refund less 3rd party booking and processing fee.

  • Cancellations less than thirty (30) days of your scheduled arrival date will receive no refund.

  • No refunds or credits for late arrivals or early departures.

  • No refund given for all or part of your party not showing up for your reservation.

MAXIMUM OCCUPANCY / NO PETS

The Ledge has 3 queen beds and can sleep a total of 6 guests. The Study has 2 queen beds and can sleep a total of 4 guests. We do not permit pets on our property for numerous reasons, including safety concerns, allergies and potential pet damages to our home. As a courtesy to us (the designers, builders, investors, maintainers, cleaners) and all future guests (who expect a “no pet” property), we ask that you do not stay with us if you require a service animal. There are many pet friendly cabins in the Hocking Hills and we can recommend some to you if you need help locating a place to stay.

VEHICLES / WEATHER

Our property is steep and requires an all wheel drive vehicle during the winter months. The Owner plows and maintains the drive, but AWD is required to safely travel. Please park in one of the three parking spots and walk down the steps to enter the cabin. Do not drive down the concrete path.

Please acknowledge that you are responsible for getting to/from your cabin. All of our cabins have gravel driveways and some can be steep in spots. Although most cars should have no problem during most of the year, during winter months and/or inclement weather 4WD is strongly recommended. Please be careful driving. Owner/Agent shall not be held responsible for any accident and/or getting stuck for any reason at any time. If a tow is required, it will be at your expense – no exceptions.

We have generators should power go out during your stay. Occasionally, internet service will go out in adverse weather. Should that occur, most cell services do not work in the cabin without WiFi. If you have an urgent need to make a call, you should have cell service at the top of the drive by the pillars.

USE OF ALCOHOL, DRUGS, SMOKING, FIREARMS AND FIREWORKS

  • Consumption of alcoholic beverages by adults of legal drinking age is permitted. If underage drinking is discovered, renters will be asked to leave the premises.

  • Absolutely NO illegal drugs are allowed on the property.

  • Smoking/vaping is not permitted inside or around our cabin. Guests are welcome to smoke around the fire pit area, but must clean up after yourselves. Cigarette/cigar butts found around property will result in additional cleaning charges.

  • ABSOLUTELY NO FIREWORKS AND/OR FIREARMS SHALL BE SET OFF OR DISCHARGED ON THE PROPERTY. If any damage to the structure or the surrounding area is evident, you will be subject to additional fines and/or legal action.

NOISE / QUIET HOURS

Our cabins sit on 24 secluded acres. Though you won’t see your neighbors, they can hear you. Please keep this in mind when celebrating and enjoying your stay. Please be respectful of them and keep noise levels to a minimum so as not to disturb others. Please bring excessive celebrating/noise indoors by 10pm.

INJURY/LOSS/ILLNESS (Indemnification & Waiver)

  • The owners are not responsible for any accidents, events, injuries, or illness that occur while on the premises or facility to any person or property. By accepting a reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use or occupancy of the premises.

  • You hereby agree to indemnify, defend and hold Lost Cavern LTD , the property owner, and any affiliated party harmless from any and all claims, demands, costs, liabilities, losses, expenses and damages (including reasonable attorneys’ fees, costs, and expert witness fees) arising out of your use of the property, or any use of the property by your guests or invitees.

  • As previously stated, the cabins of Lost Cavern LTD lie on steep terrain. Renters assume all risks and should only stay in designated areas. Wildlife can be dangerous and plants/berries may be poisonous. Trees/limbs occasionally fall. Owner is not responsible for any damages/injury. Individuals can be harmed by falling from the stairs and decks surrounding the cabin. Please watch your children closely at all times. Roads on the property are gravel and require slow and careful driving. You hereby assume full responsibility for your own safety and the safety of your guests and invitees as well as your actions or any of your guest’s actions in the above mentioned dangers as well as the dangers not specifically noted. Renter acknowledges for themselves and their guests and invitees that decks, sidewalks and all other surfaces are slippery when wet or during inclement weather.

EQUIPMENT AND FURNISHING

  • Equipment failures must be reported immediately (ie: no heat/AC, no water, hot tubs, TV etc). Repairs will be made as quickly as possible. Please call Justin at (740)819-3156 if problems arise. There are no refunds for rare inability to use.

  • Local fire, police and emergency services should be contacted when assistance is needed.

  • Renters are expected to care for property as if it were their own.

  • Only use appliances for their intended uses.

  • Rearranging furniture, electronic components is strictly prohibited.

  • Clean the grill after each use. Ash cans/supplies are provided.

  • Our cabin is heated through radiant floor heat. It takes time to cool down/heat up. To cool down quickly in the fall/winter, open windows. Please do not open windows/doors when using AC in the summer months. Please do not operate the fireplace while using AC.

HOUSEKEEPING/OCCUPANCY

  • Instructions on check-in will be sent to you before your stay.

  • We cannot accommodate early check-in and/or late check out times. The Ledge check-in is anytime after 4pm, check-out by 11am. The Study check-in is anytime after 3pm, check-out by 10am. Be respectful of the times listed as we are doing our best to prepare for our next guests.

  • If the condition of the facility is not left in appropriate shape, loss of revenue charges will be charged.

  • Please return the key to the lock box upon departure.

HOT TUB

  • We will not issue refunds for hot tub failures or for the rare instances of inability to use during your stay. We will do everything within our power to fix any issue promptly.

  • All non-adults must be supervised by an adult when they use the hot tub.

  • Hot tub covers must remain on the hot tub when not in use and secured by straps.

  • Guests staying 3 or more nights will be contacted by a representative of the owner about maintenance of the hot tub.

  • Do not sit or stand on hot tub covers. This can break and damage the lid.

  • Damage to hot tub covers will result in a replacement fee.

  • Use of the hot tub is entirely at the risk of all guests. Any issues arising from a result of hot tub use is solely the renter’s responsibility. Enter at your own risk. Please follow all safety instructions posted at your lodge.

  • Glass is not permitted in/around the hot tub.

  • Food in hot tub is prohibited

  • Use of electronic devices in/around the hot tub is prohibited.

FIREPLACE

  • Shut the fireplace screens when in use.

  • A designated outdoor fire ring is located at each of our cabins. Fires are only permitted at these locations and must be contained within the fire ring. We provide a bundle of firewood. More may be purchased beside the local gas station.

    DO NOT CUT OR TAKE FIREWOOD FROM THE WOODS OTHER THAN SMALL STICKS FOR KINDLING. WET LOGS TAKEN FROM THE WOODS WILL NOT BURN AND WILL LEAVE LARGE PARTIALLY BURNT LOGS THAT WE NEED TO REMOVE

AMENITIES

Owner/Agent is not responsible for mechanical failures of non-essential items, including but not limited to hot tubs, televisions, music players, internet/telephone/cable access, dishwashers, washer/dryers, fireplaces, air conditioning or any other mechanical device that fails to operate during your stay. Management will make every reasonable effort to repair any malfunctioning item during your stay; however, no refunds will be provided for any mechanical failure out of our control.

ACTS OF NATURE

No refunds will be issued for any utility disruption including, but not limited to power outages, water outages, satellite and/or Internet outages, etc... These failures are
beyond our control and no refund will be given.

LOST ITEMS

Owner/Agent is not responsible for lost, stolen or forgotten personal belongings. Please check your cabin thoroughly for any personal belongings when leaving.

DAMAGE BY RENTER OR GUESTS:

  • In the event of damages or extra cleaning requirements created by renter or guests not covered above, additional charges may be applied to the security deposit.

  • The Responsible Party/Renter assumes all financial responsibility for any and all damages that occur at or on the property as a result of your use or stay. Each cabin is thoroughly inspected for damages before and after each rental. If you notice any damages at check-in, please contact us immediately. Charges will equal either all the costs of the repair or replacement costs. Renter agrees that the credit card submitted for payment or held on file for deposit shall be charged to cover any such damage and an itemized list of any damages will be sent to the Renter at the time of processing payment.

  • Renter shall be charged for any excessive cleaning that is required following check-out as a result of your stay. Excessive cleaning includes but is not limited to discarding of excess trash, fumigation, excessive cleaning of appliances, dishes, soiled floors, items requiring professional cleaning such as carpet or fabric stains on furniture.

  • This agreement shall be governed by and construed in accordance with the laws of the State of Ohio. Any action brought by either party against the other concerning the transactions contemplated by this Agreement shall be brought only in a court of proper jurisdiction in Hocking County, Ohio.

PLEASE FORWARD THIS AGREEMENT ONTO ANY MEMBERS OF YOUR PARTY FOR FULL UNDERSTANDING BY ALL GUESTS. FAILURE TO FOLLOW THESE SIGNED POLICIES WILL RESULT IN DEDUCTIONS FROM THE SECURITY DEPOSIT AND/OR FEES CHARGED
